Private Parking Charges & Appeals

Can a private parking company win in court without knowing who was driving?

It depends on the evidence. In Northern Ireland the keeper is not automatically liable under the England-and-Wales keeper-liability regime, so the operator still needs to establish a legal basis for liability against the person it sues.

The Consumer Council says the driver is liable for private parking charges in Northern Ireland and that a keeper who was not driving can challenge the operator to provide evidence of driver identity. If a case reaches court, the judge can consider all available evidence about who was driving and what happened.

The operator may rely on admissions, correspondence, witness evidence, photographs or other material. The respondent can rely on contrary evidence and can also dispute the signage, payment history, ANPR accuracy or the alleged breach itself.

There is no sensible rule that a private parking company 'always wins' or 'can never win'. Court outcomes depend on the facts and evidence in the individual case, which is why preserving records from the parking event matters.
