What happens if I fail a roadside breath test in Northern Ireland?

Once the preliminary result gives police reasonable grounds to suspect that the alcohol level exceeds the prescribed limit, NI law allows the drink-driving investigation to move to evidential specimens. Those may be taken at a police station or, in circumstances allowed by law, at or near the roadside or at a hospital.

For evidential breath analysis, two specimens are normally required and the statutory rules determine which result is used. Blood or urine can be required where the legal conditions for those alternatives are met.

After evidential testing, police decide whether there is sufficient evidence for charge or other action. A driver may also be detained until police are satisfied they would not commit a further drink/drug driving offence if released to drive.

The NI enforcement process separates screening from evidential proof. A roadside breath test, DrugWipe or impairment check gives police information and may justify arrest or further testing, but the prosecution is built from the statutory evidential procedure, officer observations and any laboratory or approved-device result. That distinction matters when reading reports of someone having “failed a roadside test”. Applied to the actual NI case, a failed roadside breath test can lead to arrest or detention for evidential testing; the roadside device is a screening stage rather than the final court evidence by itself.
